The Sixty-Nine Days · claim A6

ANALYSISOur labeled inference. Falsifiers listed.

Our reading, about timing only: if CNBC is right, a confidential registration statement for an OpenAI public offering sat with the SEC through the whole window in which the July 21 post left out what the company knew, the tender closed, and the DXYZ wire cleared. A company with a draft prospectus on file is a company deciding, every week, what belongs in it. We have not seen the filing and claim nothing about what it says or omits.

The innocent reading

Confidential draft registration statements are routinely filed early and amended many times before they go public; nothing requires a company to update a confidential draft on any schedule, and the incident may well be in it. Filing in June says nothing about August.

What would prove us wrong

  • The registration statement, when public, shows the incident disclosed in a version dated before August 26.
  • OpenAI states the confidential filing date and it falls outside the window.
  • CNBC's report of a June filing is withdrawn or contradicted by a primary.
