We asked the Inspector General whether the FTI referral is open, closed, or resolved. The answer, through a public-affairs consultant, attributed at the office's request to 'OIG officials': the office does not publicly acknowledge whether it is investigating a matter or not, and 'does not waive confidentiality for full reports,' citing the statute that makes every investigative report confidential. The statute they cite says the report 'is confidential in accordance with section 8.' Section 8 says investigative records 'may be kept confidential in whole or in part,' and that a person may disclose them 'if the governor authorizes the disclosure of this information in the public interest.' The governor who ordered the review can open its outcome. The same section also shields the records from civil discovery unless a court finds 'particularized need' and that the information 'cannot be obtained from any other source,' so a lawsuit is not the easy route either; the governor's signature is.

The passage

the OIG has a long-standing policy that whether the OIG is investigating a matter or not, the OIG does not publicly acknowledge such.
